Tradelicense.cz / Registering a živnostenský List at Commercial Court
Which nationality do you have? Even some 3rd-Country Nationals do not have to register at Commercial Court!
For EU Citizens and family members:
There is no need to register at the Commercial Court.
For 3rd-Country National with Temporary or Permanent Residence permit:
There is no need to register at the Commercial Court.
3rd-Country National without D-Visa:
The trade license register will only issue a proof that you are entitled to receive a trade license. This proof comes without IČO, making it impossible to register at the tax / social / health office AND you are not allowed to trade.
You must register at Commercial Court within 3 months.
The only way to get the IČO is presenting proof that you are registered at Commercial Court (Obchodní Rejstřík). This registration is a lot more complicated and expensive than the tradelicense registration procedure itself, since it resembles registering an sro at Commercial Court.
After getting the proof that you are registered at the Commercial Court (a výpis z obchodního rejstříku), it needs to be filed at the trade license register (živnostenského rejstřík) and you will get a new extract from the trade license register (výpis z živnostenského rejstříku) and with that we can complete your registration at the tax / social authorities.
3rd-Country National with D-Visa:
See above, only you get the trade license (not the proof) but also without IČO.
You must register at Commercial Court within 3 months.
The rest of the procedure is the same.
If you are going to leave your employment and take the trade license as main activity, also you must change the purpose of stay at the Foreign Police, which means you will not have to go to an embassy abroad, but you must comply to the rules for a Business Visa.
In some cases, for 3rd country nationals from non-western countries it might be better / easier to found a new company (sro) instead of registering a živnostenský list.
