Business Visa

Most 3rd-Country Nationals will need a Business Visa in order to be able to work on a trade license. Unfortunately a C-Visa or a so-called visa-free entry (US, CAN) cannot be changed into a D-Visa for Business purposes. You will have to apply again at an embassy outside Czech Republic, UNLESS you have an EU partner / spouse and are entitled to receive an EU Residence Permit.

Commercial Court

Unlike EU-Citizens, 3rd-Country Nationals that do not have a permanent Residence Permit, also need to register their trade license business at Commercial Court.

Criminal record

An extract of the criminal record is always required if you are a 3rd-Country National, but also if you are an EU-Citizen and have stayed in Czech Republic shorter than 3 months. For EU-Citizens longer than 3 months in CZ, there is no need to get a criminal extract.

Freelance business

Instead of hiring you as employee, many companies are much more willing to pay your freelancer company. It saves them a lot of social- and health charges, and they do not have to pay months of salary should they decide to fire you.

Legal entity

The Trade License is not a separate legal entity, unlike an sro company. This means that with an sro you are personally responsible (liable) for the height of the basic capital (200.000 CZK). Using a trade license your liability is your entire private capital. This is an issue if you sign million-crown contracts.

Residence permit

It is not possible to get a Permanent Residence Permit right away. You must have stayed in Czech Republic for a period of 5 years in order to apply for a Permanent Residence Permit. For 3rd-Country Nationals: if you have it, there is no need to register at Commercial Court anymore.

Trade license company

Strictly speaking, a Trade License is not a company because it is not a separate legal entity. It would be more correct to say 'Trade License Business', although it is treated almost as a company in Comercial Court.
The same goes for 'Freelance Company' or 'Freelancer Company'. It would be more correct to speak of 'Freelance Business' or 'Freelancer Business' because by definition, a Freelancer (working Freelance) is not an employee, but also not a company. Instead he is independently self-employed.

Visa application

In order to do business in Czech Republic, the Business Visa application (of the C+D Visa type) must be made in advance in your home coutry or at an embassy outside CZ (only for some nationalities). It is not possible to travel to Czech Republic and get it there, even if you have a Tourist Visa or a Visa-Free Entry.
